    Supreme Court of Canada dismissed Forcillo’s appeal

    Top Court of Canada refused an appeal from a Toronto police officer who was jailed for the shooting of a teenager 5 years ago on an empty streetcar.

    A decision was released on Thursday in which the Supreme Court of Canada denied Police Constable James Forcillo leave to appeal his conviction.

    In the year 2016, Forcillo was charged for the second-degree murder of Sammy Yatim, an 18-year-old boy, who was holding a knife but convicted this police officer of attempted murder.

    Forcillo’s lawyers argued first and second volleys that the officer fired were divided artificially into the discrete events. They too wanted to contest his first six-year sentence, which was a year longer as compared to the mandatory minimum.

    Forcillo was the very first police officer who responds to a call about a teen exposing himself on a streetcar while branding a small knife. When the police arrived, Yatim was the only person who left on the streetcar in the early morning of July 2013.

    Forcillo fired three shots, that caused Yatim to fall down to the floor of the streetcar and then fired on the second volley of 6 more shots. Forcillo was the only officer who fired his weapon.

    Top Court of Ontario denied Forcillo’s appeal in April and prompted him to apply to the Ontario’s Supreme Court.
